Welcome to Fits Right. These Terms & Conditions (“Terms”) govern your use of the Fits Right mobile application (“App”) and related services provided by Fits Right Ltd (“we”, “us”, or “our”), a UK-registered company.
By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 16 years old to use the Fits Right App. By using the App, you confirm that you meet this requirement.
2. Your Account
To use the App, you must create an account. You agree to provide accurate and complete information and keep it up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out under your account.
3. Use of the App
The Fits Right App provides size recommendations and fitness-related insights based on body measurement data.
Users may purchase 3D body scanning services to unlock additional features.
You must not:
- Use the App for unlawful, abusive, or harmful purposes
- Attempt to reverse-engineer, disrupt, or compromise the App
- Upload or share offensive, misleading, or inappropriate content
- Circumvent affiliate links or tracking mechanisms
4. Ownership & Use of Data
You retain ownership of your personal data, including body measurement data associated with your account. You may export or delete your data at any time in accordance with our Privacy Policy.
By using the App, you grant Fits Right Ltd the right to:
- Collect and process your data to provide the App’s functionality
- Anonymise and aggregate data so that it no longer identifies you
Anonymised Data
Fits Right Ltd may use, analyse, and share fully anonymised and aggregated data with third parties for research, analytics, product development, and commercial purposes.
Once data has been anonymised, it is no longer considered personal data under UK GDPR and cannot be used to identify any individual.
5. Payments
The App is free to download and use. Certain features, including 3D body scanning services, require payment.
All purchases are final unless otherwise required by law.
6. Affiliate Links
Fits Right may include affiliate links to third-party retailers. If you make a purchase via these links, we may receive an anonymised referral notification.
This does not affect pricing or your experience.
7. Termination
We may suspend or terminate your access to the App if you violate these Terms, our policies, or applicable laws.
You may delete your account at any time via the App. Account deletion permanently removes associated personal data in line with our Privacy Policy.
8. Third-Party Websites
The App may link to third-party websites or services. We are not responsible for their content, availability, or privacy practices.
9. Limitation of Liability
To the fullest extent permitted by law, Fits Right Ltd shall not be liable for any indirect, incidental, or consequential losses arising from your use of the App or reliance on its outputs.
The App is provided for informational and guidance purposes only.
10. Changes to These Terms
We may update these Terms from time to time. If significant changes are made, we will notify you via the App or email.
Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
